A Power of Attorney may be registered by a person to grant authority to another person to represent them on their behalf, to perform a certain task, to execute an action, or to carry on any trade or business. Every Power of Attorney signed within Sri Lanka or in any other country must be registered in this Department.
If drawn and signed in Sri Lanka, it must be submitted to this Department for registration within one month from the date of signing, and if drawn and signed outside Sri Lanka, it must be submitted within 03 months from the date of signing.
Local and foreign Powers of Attorney drawn and attested in accordance with the Powers of Attorney Ordinance, No. 04 of 1902, can be submitted for registration to any Zonal Office or District Assistant Registrar General's Office, irrespective of the residential addresses of the donee.
In accordance with the Powers of Attorney (Amendment) Act, No. 28 of 2022, when drawn and signed within Sri Lanka, it must be drawn and attested by a Notary Public in the presence of two witnesses.
When drawn and signed outside Sri Lanka, it must be drawn and signed in the presence of two witnesses and before an Ambassador, High Commissioner, Diplomatic Officer, Consular Officer, or any person authorized to draw and attest a Power of Attorney according to the law of that country.
Documents to be submitted:
- The original copy of the Power of Attorney.
- A copy of the Power of Attorney certified as a true copy by a Notary Public.
- The affidavit as specified in the Schedule of the Powers of Attorney (Amendment) Act, No. 28 of 2022.
- A copy of the National Identity Card, Passport, or Driving License of the grantor and the donee of the Power of Attorney, certified by a notary.
- If it is a Power of Attorney drawn and attested abroad, a copy of the bio-data page of their passport, certified (signed) by the grantor themselves.
