ඇටෝර්නි බලපත්‍ර ලියාපදිංචි කිරීම

• යම් තැනැත්තෙකු වෙනුවෙන් ඔහුව නියෝජනය කිරිමට, යම් කාර්යයක් ඉටුකිරීමට, ක්‍රියාවක් කිරීමට හෝ යම් වෙළදාමක් හෝ ව්‍යාපාරයක් කරගෙන යාමට එවැනි තැනැත්තෙකු විසින් තවත් තැනැත්තෙකුට බලය දිම සදහා ඇටෝර්නි බලපත්‍රයක් ලියාපදිංචි කරගත හැක. ශ්‍රි ලංකාව තුල හෝ වෙනත් යම් රටක අත්සන් කරන සෑම ඇටෝර්නි බලපත්‍රයක්ම මෙම දෙපාර්තමේන්තුවේ ලියාපදිංචි කළ යුතුය.
• ශ්‍රි ලංකා‍වේදී ලියා අත්සන් කරන ලද්දක් නම් අත්සන් කරන ලද දින සිට එක් මාසයක කාලයක් ඇතුලතද, ශ්‍රී ලංකාවෙන් පිටතදී ලියා අත්සන් කරන ලද්දක් නම් අත්සන් කරන ලද දින සිට මාස 03 ක කාලයක් ඇතුළත ද ලියාපදිංචිය සඳහා මෙම දෙපාර්තමේන්තුවට ඉදිරිපත් කළ යුතුය.
• 1902 අංක 04 දරණ ඇටෝර්නි බලපත්‍ර ආඥා පනත අනුව ලියා සහතික කරන ලද දේශීය හා විදේශීය ඇටෝර්නි බලපත්‍ර, ඇටෝර්නි බලකරුගේ පදිංචි ලිපින නොසලකා ඕනෑම කලාප කාර්යාලයක හෝ දිස්ත්‍රික් සහකාර රෙජිස්ට්‍රාර් ජෙනරාල් කාර්යාලයකට ලියාපදිංචිය සදහා ඉදිරිපත් කල හැක.
• 2022 අංක 28 දරණ ඇටෝර්නි බලපත්‍ර සංශෝධන පනත අනුව ශ්‍රි ලංකාව තුලදි ලියා අත්සන් කරන විට සාක්ෂි කරුවන් දෙදෙනෙකු ඉදිරියේ ප්‍රසිද්ධ නොතාරිස් වරයෙකු විසින් ලියා සහතික කල යුතුය.
• ශ්‍රි ලංකාවෙන් පිටතදි ලියා අත්සන් කරන විට සාක්ෂි කරුවන් දෙදෙනෙකු ඉදිරියේ සහ තානාපතිවරයෙකු හෝ මහකොමසාරිස්වරයෙකු හෝ රාජ්‍ය තාන්ත්‍රික නිළධාරියෙකු හෝ කොන්සල් නිළධාරියෙකු හෝ එම රටේ නීතිය අනුව ඇටෝර්නි බලපත්‍රයක් ලියා සහතික කිරිමට බලය ලබා ඇති යම් තැනැත්තෙකු ඉදිරියේ ලියා අත්සන් කල යුතුය.
• ලියාපදිංචිය සඳහා ඉදිරිපත් කළයුතු ලියවිලි,
  • ඇටෝර්නි බලපත්‍රයේ මුල් පිටපත
  • ප්‍රසිද්ධ නොතාරිස්වරයෙකු විසින් සත්‍ය පිටපතක් බවට සහතික කරන ලද ඇටෝර්නි බලපත්‍රයේ පිටපතක්
  • 2022 අංක 28 දරණ ඇටෝර්නි බලපත්‍ර (සංශෝධන) පනතේ, උපලේඛනයේ දක්වා ඇති පරිදි දිවුරුම් ප්‍රකාශය
  • ඇටෝර්නි බලපත්‍රයේ ප්‍රදානකරුගේ හා ලැබුම්කරුගේ ජාතික හැදුනුම්පත, විදෙස් ගමන් බලපත්‍රය හෝ රියදුරු බලපත්‍රයේ නොතාරිස්වරයා විසින් සහතික කල පිටපත
  • විදේශයකදි ලියා සහතික කරන ලද ඇටෝර්නි බලපත්‍රයක් නම් ප්‍රදානකරු විසින්ම සහතික (අත්සන්) කරන ලද ඔහුගේ විදේශ ගමන් බලපත්‍රයේ ජීව පිටුවේ පිටපතක්

ලියාපදිංචි කරන ලද ඇටෝර්නි බලපත්‍ර අවලංගු කිරීම

• ඇටෝර්නි බලපත්‍රයක් අවලංගු කිරිමට, ප්‍රදානකරු හෝ ඇටෝර්නි බලකරු අදහස් කරන විට එම අදහස අනෙක් පාර්ශවයට දැනුම් දිය යුතුය. අවලංගු කිරිමට අදහස් කරන පාර්ශවයේ අදහස ප්‍රකාශ වන පරිදි ප්‍රසිද්ධ නොතාරිස්වරයෙකු විසින් ලියා සහතික කරනු ලබන ලේඛනයක්, ඇටෝර්නි බලපත්‍රය ලියාපදිංචි කරන ලද කාර්යාලයට ඉදිරිපත් කල යුතුය. • ඉදිරිපත් කල යුතු ලේඛන,
  
  • ප්‍රසිද්ධ නොතාරිස්වරයෙකු විසින් ලියා සහතික කරන ලද අවලංගු කිරිමේ ලේඛනයේ මුල් පිටපත
  • ඇටෝ‌ර්නි ප්‍රදානකරුගේ හා ලැබුම්කරුගේ සම්පුර්ණ නම, ලිපිනය, හා ජාතික හැදුනුම්පතෙහි හෝ විදෙස් ගමන් බලපත්‍රයේ , රියදුරු බලපත්‍රයේ සහතික පිටපත
  • ප්‍රසිද්ධ නොතාරිස්වරයෙකු විසින් සත්‍ය පිටපතක් බවට සහතික කරන ලද අවලංගු කිරිමේ ලේඛනයේ පිටපත (මුල් පිටපත සමඟ ඉදිරිපත් කල යුතුයි.)
  • ලියාපදිංචි කරන ලද ඇටර්නි බලපත්‍රයේ මුල් පිටපත හෝ ලියාපදිංචි කරන ලද කාර්යාලයෙන් ලබාගත් සහතික පිටපත
• ඇටෝර්නි බලපත්‍රයක ප්‍රදානකරුට වහාම ක්‍රියාත්මක වන පරිදි ඔහුගේ ඇටෝරනි බලපත්‍රය අවලංගු කිරීමට අවශ්‍ය වනවිටක අවලංගු කිරීමේ ල‍ේඛනයක් ඉදිරිපත් කරන තෙක් ඇටෝර්නි බලපත්‍රය අවලංගු කිරීමට අදහස් කරන බව‍ට වූ දැන්වීමක් රෙජිස්ට්‍රාර් ජනරාල් වෙත ලියාපදිංචිය සඳහා ඉදිරිපත් කල හැක.

Registration of movable and immovable properties

Eligibility                                                                                             

This service is being provided by the Registrar General s Department to the public at instances where either a

Movable or an Immovable property being registered under a new owner.

Instrument (Document)

Instrument (Document) shall be prepared according to provisions of the Notaries ordinance and Registration ordinance and other related laws.

Hours of business

9.00 a.m to 15.45 p.m, except on Saturdays, Sundays and public holidays

Submission procedure

Instrument (Document) should be tendered to the relevant Land Registry where the land is situated. Land or movable property situated in more districts than one may be presented for registration to the Registrar General. Instrument (Document) could be submitted on either of the following manners:

a. Being submitted through post

b. Being submitted by authorized person

c. Being submitted through a notary/ legal firms

Who may present document for registration

1. Any person executing the document
2. Any person claiming any interest or benefit thereunder
3. Any person having any interest in or charge on any property affected thereby
4. The agent of any such person or an attorney-at-law or notary acting on behalf any such person; letter of authority should be submit if the agent of any such person is presented document for registration

Instrument (Document) Required

1. The original
2. Duly attested or certified copy

In the case of a will, the probate or letters of administration with a copy of a will annexed shall be presented for registration.

Fee:

Registration fee can be paid in cash or should attached bank receipt which deposit fees to account no 7041650 of Registrar General’s account through any branch of Bank of Ceylon

1. Every instrument of any kind whatsoever not expressly exempted :- Rs. 100.00
2. For each land described in the Caveat, for each period of two years:- Rs. 2500.00
3. An instrument presented to the Registrar General, In addition to any other fee payable:- Rs. 1000.00
4. Appropriate un-cancelled stamp has to be affixed according to other related laws

Steps

1. Receive Instrument and registration fee
2. Issue Day Book receipt and cash receipt
3. Check compliance with related laws and regulations
4. Register or refuse and endorse

Rectification of Registered Documents

• Can apply for rectifications if the registered documents are written incorrectly in the Land Registry.
• Relevant parties should submit a letter containing requests to the Registrar of Lands in the Land Rgistry where the documents are registered.
• Documents should be submitted,
  • Copies of the folio recorded incorrectly
  • Affidavit containing how the rectification should be done
  • Original of the deed which recorded incorrectly
• Land Regitry will do the corrections and inform the applicant.

Obtain a certified copy of  Registered document in the Land Registry

• Can apply by post or personally from the relevant Land Registry.
• Applications can be obtained from the Land Registry.
